Welcome to AusGuard. By downloading, accessing, or using our mobile application ("the App"), you agree to these Terms of Use. Please read them carefully.

1. Acceptance of Terms

By using AusGuard, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

AusGuard is a weather and safety information application designed for Australian conditions. The App provides:

• Real-time weather forecasts and severe weather warnings
• Bushfire incident tracking and flood monitoring
• Air quality index (AQI) and UV index information
• Emergency preparedness guides and safety resources
• Lifestyle indices (beach, surf, etc.)
• Transit, parking, fuel price, and other convenience information
• Home Screen and Lock Screen widgets

3. Disclaimer — Not a Substitute for Official Emergency Services

IMPORTANT: AusGuard provides general information only and is not a substitute for official emergency services. During emergencies:

• For life-threatening situations, always call 000 immediately
• Always follow the advice and instructions of official emergency services and authorities
• AusGuard is an independent application and is not affiliated with the Australian Government, Bureau of Meteorology (BOM), or any state emergency service

You acknowledge that AusGuard is not responsible for any decisions you make based on the information provided in the App.

4. Data Accuracy and Availability

AusGuard aggregates data from multiple Australian government and international sources. While we strive to provide accurate and timely information:

• We do not guarantee the accuracy, completeness, or reliability of any data displayed
• Data sources may experience outages, delays, or inaccuracies beyond our control
• The App may display "No Data" or cached information when live data is unavailable
• Weather forecasts are inherently uncertain and should be used as guidance only

5. Intellectual Property

AusGuard, including its design, code, graphics, and branding, is the intellectual property of the developer. You may not copy, modify, distribute, or reverse-engineer any part of the App without prior written permission.

6. Pro Subscription

AusGuard offers an optional Pro subscription that unlocks premium features including AI weather summaries, premium weather share cards, weekend planning, photography weather, lifestyle forecasts, and travel planning extras.

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

7. Support Developer (One-Time Purchases)

AusGuard offers optional one-time consumable purchases (e.g., "Buy Me a Coffee") to support ongoing development. These purchases:

• Are entirely voluntary
• Do not unlock any additional features
• Are non-refundable consumable in-app purchases

8. Limitation of Liability

To the maximum extent permitted by Australian law, the developer of AusGuard shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

• The use or inability to use the App
• Reliance on any information provided by the App
• Any errors, omissions, or inaccuracies in the data displayed
• Service interruptions or data unavailability

This limitation applies even if the developer has been advised of the possibility of such damages.

9. Privacy

Your use of AusGuard is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the data practices described in the Privacy Policy.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
